Legal access is the single most valuable feature of a raw land parcel, and the single most misunderstood. Physical access (a dirt track you can drive on) is NOT the same as legal access (a recorded right you can defend in court).
What Legal Access Actually Requires
At least one of the following must be recorded in the county:
- Frontage on a public road (dedicated and maintained)
- A recorded ingress/egress easement across a neighboring parcel to a public road
- Membership in a legally recorded private road association
A dirt path the family has driven for 40 years, with no recorded easement, is prescriptive at best, and prescriptive easements require litigation to establish. Do not assume you have access just because you have been using access.
Types of Easements
- Ingress/egress: right to enter and exit the property
- Utility: right for utility companies to run lines across the property
- Conservation: permanent restriction on development (often perpetual)
- Solar/view: prohibits blocking sunlight or scenic views
- Drainage: right to drain water across the property
Each type affects value differently. A utility easement is usually neutral. A conservation easement can eliminate 80 percent of the value.
The Landlocked Parcel Problem
A landlocked parcel has no legal access to a public road. Buyers cannot get title insurance for it without an access carve out. Lenders will not lend on it. Development is impossible without securing an easement first, and neighbors are usually unmotivated to grant one for less than a substantial payment.
Selling a landlocked parcel typically means:
- Negotiating an easement with the adjoining owner (often 15 to 25 percent of the parcel's improved value)
- Selling to the adjoining owner directly (usually at a steep discount)
- Pursuing an easement by necessity through the courts (slow and expensive)
What Buyers Actually Check
Professional land buyers verify access three ways:
- County plat map showing the parcel's road frontage
- Recorded easement documents (deed of easement) referenced on the title report
- Physical inspection confirming the recorded access matches the ground
